Griffin: ‘I am reminding Arkansans that calling 811 isn’t optional; it’s the law.’
LITTLE ROCK – After sending an enforcement advisory to the Arkansas Public Service Commission and the Arkansas Contractors Licensing Board, Attorney General Tim Griffin issued the following statement:
“Today I made it clear that in Arkansas, the safety of our citizens comes first. I’ve sent an enforcement advisory to the Public Service Commission and the Contractors Licensing Board stating that I intend to utilize the authority given to me by the General Assembly to enforce the Arkansas Underground Facilities Damage Prevention Act (AUFDPA).
“Violations of the AUFDPA have been increasing for some time, and many companies and contractors have grown accustomed to not calling 811 before starting projects. This practice can be dangerous and costly to Arkansans when the projects are in areas where utility lines may be buried.
“During the 94th General Assembly, the legislature passed Act 309, which established new, increased financial penalties and mandatory training for those who violate the provisions of the AUFDPA. With the release of my advisory today, I am reminding Arkansans that calling 811 isn’t optional; it’s the law.”
To facilitate reporting of AUFDPA violations, the Attorney General has created a new complaint form, which can be filled in and emailed or printed out and mailed to the Office of the Attorney General. The enforcement advisory, which includes a link to the complaint form and instructions on submission, can be accessed by going to https://arkansasag.gov/resources/file-an-811-complaint/.
